ViralPhrase respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Service.

1. Our Commitment

ViralPhrase is an educational reference platform that documents viral internet phrases and culture. We make every effort to:

  • Provide proper attribution for referenced content
  • Use third-party content under fair use principles for commentary, criticism, and educational purposes
  • Respond promptly to valid takedown requests
  • Remove or disable access to infringing material

2. Notification of Infringement

If you believe that content on our Service infringes your copyright, please submit a DMCA takedown notice containing the following information:

  1. Physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list
  3. Identification of the material that is claimed to be infringing, including the specific URL(s) or other location information
  4. Your contact information including name, address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney fees.

4. Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or disabled and where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for your judicial district (or if outside the U.S., any judicial district in which ViralPhrase may be found)
  6. A statement that you will accept service of process from the person who provided the original notification

5. Process Timeline

Upon receiving a valid DMCA takedown notice:

  • We will remove or disable access to the allegedly infringing content promptly
  • We will notify the user who posted the content (if applicable)
  • If we receive a valid counter-notification, we will provide it to the original complainant
  • If the complainant does not file a court action within 10-14 business days, we may restore the content

6. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also limit access to the Service and/or terminate the accounts of users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

7. Fair Use

ViralPhrase documents and comments on internet culture for educational and informational purposes. Much of our content may qualify as fair use under 17 U.S.C. ยง 107, which permits use of copyrighted material for purposes such as:

  • Criticism
  • Comment
  • News reporting
  • Teaching
  • Scholarship
  • Research

We consider fair use factors when determining whether to use third-party content. However, we will still respond appropriately to valid DMCA notices.
